1. Acceptance of Terms
By accessing or using FreightPass at freightpass.app, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the platform. These Terms apply to all users including brokers, brokerage administrators, dispatchers, drivers, warehouse staff, and customers.
2. Platform Description
FreightPass is a freight verification and chain-of-custody platform operated by MileHigh Digital LLC. FreightPass enables brokerages, warehouses, drivers, dispatchers, and customers to coordinate freight shipments with identity verification, geofence-based arrival detection, QR-code check-in, document management, and real-time status tracking.
FreightPass is a tool for operational coordination and verification. It does not serve as a freight broker, carrier, or shipper, and does not assume liability for the freight itself.
3. SMS Program Terms
Program name: FreightPass
FreightPass sends transactional SMS messages to drivers and brokers in connection with shipment operations. Dispatchers are contacted by email only, not SMS.
Driver SMS Consent
Driver SMS consent is collected in two steps. Each step authorizes a specific category of messages:
- Invitation and invitation reminder SMS — Before a driver receives their first shipment invitation text, the sender (a broker or a dispatcher acting on behalf of a broker) obtains the driver's consent to be contacted by SMS. This consent authorizes the initial invitation SMS and any invitation reminder SMS while the invitation is pending and the driver has not yet accepted.
- Ongoing shipment SMS after acceptance — After opening the invitation link, the driver enters or confirms their mobile phone number and must manually check an unchecked consent checkbox before accepting the load. This checkbox authorizes FreightPass to send ongoing shipment-related SMS such as verification codes, pickup and delivery status updates, and paperwork reminders. Consent records for both steps are stored on the driver's invitation record, including the timestamp and exact disclosure text shown.
Broker SMS Consent
Brokers opt in to operational SMS alerts through their account settings by entering a mobile phone number and checking a required consent checkbox. The consent timestamp and exact disclosure text are stored on the broker's profile. Brokers can revoke consent at any time by unchecking the checkbox and saving, or by replying STOP to any message.
Message Types
Types of transactional SMS messages:
- Drivers: Shipment invitation links, verification codes, pickup and delivery status updates, paperwork reminders, pending invitation reminders
- Brokers: Load status changes, driver updates (e.g., driver declined), shipment exceptions
Message frequency varies based on shipment activity. Drivers on active shipments may receive multiple messages per day. Brokers receive messages only for load-specific operational events.
Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
Opt-out: Reply STOP to any FreightPass SMS message to stop receiving text messages. Brokers can also revoke consent by unchecking the SMS checkbox in account settings. You may also contact us at hello@freightpass.app for assistance with SMS preferences.

SMS consent is not a condition of purchase or use of FreightPass. Your SMS consent and phone number will not be shared with third parties for marketing purposes. See our SMS Consent and Messaging Policy for full program details.
4. User Accounts & Roles
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and current information when creating your profile.
FreightPass uses role-based access control. Your access to shipment data, documents, and platform features is determined by the role assigned to you by your organization administrator or by the platform. Roles include brokerage admin, broker, dispatcher, driver, warehouse admin, warehouse user, customer, and platform admin.
Organization administrators may activate, deactivate, or change your role at any time. Platform administrators may suspend user access for policy violations or security concerns.
5. Acceptable Use
You agree not to:
- Use FreightPass for any unlawful purpose or in violation of any applicable law
- Provide false identity information or impersonate another user
- Attempt to access shipment data, documents, or features outside your assigned role
- Interfere with the platform's security features, geofence checks, or verification workflows
- Upload malicious files or content
- Use automated scripts or bots to access the platform without authorization
- Share verification codes, QR tokens, or invitation links with unauthorized parties
6. Intellectual Property
FreightPass, its logo, design, and underlying technology are the property of MileHigh Digital LLC. You may not copy, modify, distribute, or reverse-engineer any part of the platform without prior written consent.
Content you upload (documents, images, shipment data) remains your property. By uploading content to FreightPass, you grant us a limited license to store, display, and process that content as necessary to provide the platform's services.
7. Limitation of Liability
FreightPass is provided “as is” and “as available.” To the maximum extent permitted by law, MileHigh Digital LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use FreightPass, including but not limited to loss of freight, cargo damage, delivery delays, or business interruption.
FreightPass facilitates verification and tracking but does not guarantee the accuracy of GPS locations, geofence boundaries, or third-party carrier information.
8. Termination
We may suspend or terminate your access to FreightPass at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the platform ceases immediately. Data associated with completed shipments and audit records may be retained as described in our Privacy Policy.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the platform or via email. Continued use of FreightPass after changes constitutes acceptance of the revised Terms.
