1. Introduction
FreightPass (“we,” “us,” or “our”) is a freight verification and chain-of-custody platform operated by MileHigh Digital LLC. This Privacy Policy describes how we collect, use, disclose, and protect information when you use the FreightPass platform at freightpass.app, including our web application, mobile-optimized interfaces, and related services.
FreightPass serves brokerages, warehouses, drivers, dispatchers, and customers involved in freight transportation. By using FreightPass, you agree to the practices described in this policy.
2. Information We Collect
Account & Profile Data
When you create an account or are invited to FreightPass, we collect your name, email address, phone number, organization name, and role (e.g., broker, driver, dispatcher, warehouse staff, customer). Drivers may also provide their motor carrier MC/DOT number and carrier affiliation.
Shipment & Load Data
We collect information about freight shipments including reference numbers, pickup and delivery locations, scheduled appointments, commodity descriptions, equipment types, weights, rates, stop statuses, detention times, and shipment outcomes.
Location Data
During active shipments, drivers' GPS location is collected at regular intervals (approximately every 30 seconds) to enable geofence-based arrival detection, ETA calculation, and chain-of-custody verification. Location pings are stored as a time-ordered history for the duration of each shipment and retained for audit purposes.
Documents & Identity Verification
Users may upload documents including driver's licenses, bills of lading (BOL), proof of delivery (POD), rate confirmations, and insurance certificates. Driver's license images are used for identity verification at pickup and delivery facilities.
Device & Browser Metadata
We automatically collect IP addresses, browser type, operating system, and device identifiers when you access FreightPass. This data is used for security monitoring, session management, and troubleshooting.
Issue Reports
Users may submit issue reports or incident reports through the platform. These reports and any associated metadata are stored for operational and compliance purposes.
3. How We Use Your Information
- Facilitate freight shipment verification and chain-of-custody tracking
- Verify driver identity at pickup and delivery locations
- Detect geofence arrivals, calculate ETAs, and trigger status updates
- Generate warehouse shipment packets and verification emails
- Send transactional SMS messages to drivers and brokers for shipment invitations, verification codes, status updates, paperwork reminders, and operational alerts
- Send email notifications for dispatcher invitations, document verification, and operational alerts
- Maintain audit trails for compliance and dispute resolution
- Manage user accounts, roles, and organizational permissions
- Improve platform reliability and detect potential fraud or unauthorized access
4. SMS Communications
FreightPass sends transactional SMS messages to drivers and brokers. Dispatchers are contacted by email only, not SMS.
Driver SMS
Driver SMS consent is collected in two steps. Each step authorizes a specific category of messages:
- Invitation and invitation reminder SMS — Before a driver receives their first shipment invitation text, the sender (a broker or dispatcher acting on behalf of a broker) obtains the driver's consent to be contacted by SMS. This consent authorizes the initial invitation SMS and any invitation reminder SMS while the invitation is pending.
- Ongoing shipment SMS after acceptance — After opening the invitation link, the driver enters or confirms their mobile phone number and must manually check an unchecked consent checkbox before accepting the load. This checkbox authorizes FreightPass to send ongoing shipment-related SMS such as verification codes, status updates, and paperwork reminders. Consent records for both steps are stored on the driver's invitation record, including the timestamp and exact disclosure text shown.
Broker SMS
Brokers may receive operational alerts for load status changes, driver updates, and shipment exceptions. Brokers opt in by entering a mobile phone number and checking a required consent checkbox in their account settings. The consent timestamp and exact disclosure text are stored on the broker's profile. Brokers can revoke consent at any time by unchecking the checkbox and saving.
SMS messaging is strictly transactional. We do not use SMS for marketing purposes and we do not share your SMS consent or phone number with third parties for marketing.
Message frequency varies based on shipment activity. Message and data rates may apply. You can reply STOP to any FreightPass SMS to opt out, or reply HELP for assistance. See our SMS Consent and Messaging Policy and Terms & Conditions for full program details.
5. Information Sharing & Role-Based Access
FreightPass uses role-based access controls to limit information sharing to what is necessary for each user's function:
- Brokers and brokerage admins can view all shipment data, driver locations, documents, and audit trails within their organization.
- Dispatchers can view shipment details and submit driver assignments for loads they are invited to coordinate.
- Drivers can view only the loads they are assigned to. Pickup reference numbers are withheld until the driver arrives at the facility and has uploaded their driver's license.
- Warehouse staff can view shipment details only for loads with stops at their assigned facilities.
- Customers can view non-draft shipment status, delivery progress, and approved BOL/POD documents for their own loads.
We do not sell your personal information. We may share data with service providers who assist in platform operations (e.g., hosting, email delivery, SMS delivery, mapping services) under contractual obligations to protect your data. We may also disclose information when required by law, legal process, or to protect our rights.
6. Data Retention
We retain shipment data, location ping history, documents, and audit event logs for as long as necessary to fulfill compliance, audit, and chain-of-custody obligations. This retention period may extend beyond the completion of individual shipments to support dispute resolution, regulatory requirements, and fraud prevention.
Account profile data is retained for the duration of your account. If your account is deactivated or suspended, your profile and associated data are preserved (not deleted) to maintain the integrity of historical shipment records and audit trails.
7. Data Security
We implement industry-standard security measures including encrypted data transmission (TLS), secure authentication, row-level security policies in our database, role-based access controls, and audit logging of sensitive operations. Document storage uses signed URLs with time-limited access.
8. Your Rights
Depending on your jurisdiction, you may have the right to access, correct, or request deletion of your personal information. To exercise these rights or ask questions about your data, contact us at privacy@freightpass.app.
Please note that certain data (e.g., completed shipment records, audit logs) may be retained even after account deletion to fulfill legal and compliance obligations.
